Terms & Conditions - Purchasing  on Uber Shopping Mall

1. Introduction

Welcome to UBER SHOPPING MALL (“UBER SHOPPING MALL”, “we”, “our”, or “the Platform”). These Customer Terms and Conditions (“Terms”) govern your access to and use of our website, mobile application, and related marketplace services (collectively, the “Platform”).

By using the Platform, you agree to be bound by these Terms. If you do not accept them, you must stop using the Platform immediately.

We may update these Terms at any time. Updated Terms take effect when published on the Platform.

2. Our Role as a Marketplace

UBER SHOPPING MALL is an online marketplace connecting customers (“Customers”) with independent third-party sellers (“Sellers”).

  • Sellers list, sell, and ship their own products.
  • UBER SHOPPING MALL does not manufacture, own, warehouse, or fulfil any Seller products.
  • Purchase contracts are formed directly between you and the Seller, not UBER SHOPPING MALL.

UBER SHOPPING MALL provides listings, payment processing, dispute-facilitation, and platform services only.

Nothing in these Terms creates a partnership, joint venture, employment, or agency relationship between UBER SHOPPING MALL and any Customer or Seller.

3. Eligibility and Account Registration

To use the Platform, you must:

  • be at least 18 years old to make purchases or enter into transactions, and you must provide accurate, current, and complete registration information. 

You are responsible for all activity that occurs under your account and must maintain the confidentiality of your login credentials.

UBER SHOPPING MALL may accept or decline account applications at its discretion. If an application is declined, any fees paid will be refunded.

4. Pricing and Payment

All prices are displayed in Australian Dollars (AUD) and include GST, where applicable.

Prices may change at any time. If a price changes after you place an order but before processing, you will be notified and may:

  • accept the new price, or cancel the order and receive a refund.

Payments are processed via UBER shopping mall’s secure payment gateway. Any bank or processing fees charged by your financial institution are your responsibility.

5. Orders and Acceptance

When you submit an order:

  1. You make an offer to purchase products from the Seller.
  2. The Seller may accept or reject your order.
  3. An order is accepted only when the Seller confirms dispatch.

UBER SHOPPING MALL is not responsible for order acceptance, stock availability, product quality, shipping times, or fulfilment delays.

6. Cancellation, Refund & Replacement Policy

6.1 Marketplace Disclaimer

Each Seller operates under its own policies. UBER SHOPPING MALL does not control or guarantee:

  • product quality or accuracy of descriptions
  • shipping or delivery times
  • cancellations, refunds, or replacements
  • packaging or return requirements

UBER SHOPPING MALL’s role is to assist communication but not to determine Seller decisions.

6.2 Cancelling Orders Before Shipment

  • If an order has not been shipped, you may request cancellation.
  • The Seller will approve or reject the request based on their policy.
  • If approved, your payment minus any Seller-applied cancellation fees will be refunded to your original payment method or UBER SHOPPING MALL Wallet.

6.3 Orders Already Shipped

Once an item has shipped, cancellation is not possible. You may still request a refund or replacement after delivery, subject to Seller policy and your rights under Australian Consumer Law (“ACL”).

6.4 Refunds

  • Refund requests must be submitted within 3 business days of delivery unless ACL requires longer.
  • Refunds are processed only after the Seller confirms receipt of the returned item (where required).
  • Approved refunds are issued to your original payment method or UBER SHOPPING MALL Wallet.

6.5 Replacements

  • Replacement requests must be made within 3 business days of delivery unless required otherwise under the ACL.
  • If approved, the Seller will ship a replacement to the delivery address on your order.

6.6 Returns

Sellers will provide return instructions. Return postage costs are determined by Seller policy unless the ACL requires the Seller to cover them.

6.7 Non-Refundable Items

Sellers may specify products as non-refundable, including:

  • digital products
  • items opened for hygiene or safety reasons
  • goods marked as “non-returnable”

You should review each Seller’s policy before purchasing.

6.8 Australian Consumer Law

Nothing in these Terms limits your non-excludable ACL rights, including rights to refunds or replacements where goods are:

  • faulty
  • not as described
  • unsafe
  • unfit for purpose

Sellers must comply with the ACL.

7. Customer Responsibilities

You agree to:

  • provide accurate account and delivery details
  • review Seller policies before purchasing
  • comply with all applicable Australian laws
  • not engage in fraudulent, abusive, or unlawful conduct on the Platform

8. Platform Use Rules

You must not:

  • use the Platform commercially (outside normal purchasing)
  • copy or reproduce Platform content without permission
  • interfere with Platform operations or security
  • attempt unauthorised access to accounts or systems

You are responsible for your own internet and network costs.

9. Children and Minors

  • Users under 18 are not permitted to make purchases or obtain paid subscriptions.

10. Privacy

Your personal information is collected and handled in accordance with our Privacy Policy. By using the Platform, you consent to that collection and handling.

11. External Links

The Platform may link to third-party websites. UBER SHOPPING MALL is not responsible for their content, policies, or practices. You access third-party websites at your own risk.

12. User-Generated Content

By submitting reviews, comments, photos, or other content (“User Content”), you grant UBER SHOPPING MALL a worldwide, royalty-free licence to use, modify, publish, and display such content for operational and marketing purposes.

You warrant your content is accurate, lawful, and does not infringe third-party rights.

UBER SHOPPING MALL may remove or modify User Content at any time.

13. Intellectual Property

All content on the Platform is owned or licensed by UBER SHOPPING MALL.

You must not use, reproduce, or distribute Platform content or trademarks without written permission.

14. Disclaimers and Liability Limits

To the extent permitted by law:

  • UBER SHOPPING MALL does not guarantee accuracy or reliability of Platform content.
  • UBER SHOPPING MALL is not liable for outages, errors, or interruptions.
  • UBER SHOPPING MALL is not responsible for Seller acts or omissions (product quality, fulfilment, refunds, or shipping).

Nothing in these Terms excludes any rights you have under the ACL.

15. Force Majeure

We are not liable for delays or failure caused by events beyond our control, including natural disasters, labour disputes, system failures, or supply shortages.

16. Governing Law

These Terms are governed by the laws of New South Wales, Australia. You submit to the non-exclusive jurisdiction of NSW courts.

17. Changes to These Terms

UBER SHOPPING MALL may update these Terms at any time. Continued use after changes take effect constitutes your acceptance of the updated Terms.
